Tent Apps – Terms of Service

Welcome to Tent Apps! These Terms of Service (“Terms”) govern your access to and use of the website, mobile app building tools, communication management features, and marketing services provided by Zack Esgar Website Design, LLC DBA Tent Apps (“Tent Apps,” “we,” “us,” or “our”).

By creating an account, subscribing to a plan, or using our services, you (“Client,” “you,” or “your”) agree to be bound by these Terms. If you are entering into these Terms on behalf of a church or organization, you represent that you have the authority to bind that entity.

1. Services & Account Security

  • Platform Access: Tent Apps provides a software-as-a-service (SaaS) platform that allows you to manage church communications under one roof, including website editing, mobile app sync, newsletters, and social media posting.
  • Account Responsibility: You are responsible for maintaining the security of your account login credentials. You are fully responsible for all activities, data uploads, and actions that occur under your account. You agree to notify Tent Apps immediately of any unauthorized use of your account.

2. Fees, Automated Billing, and Cancellations

  • Subscription Fees: By selecting a package (including but not limited to the Communications, Church Growth, or Marketing Partner packages) and providing a payment method, you authorize Tent Apps to charge your credit card or ACH automatically on a recurring monthly or annual basis.
  • Setup Fees: Any applicable one-time setup fees (e.g., custom design packages) are invoiced and charged immediately upon registration.
  • Late Payments & Failed Charges: If an automated payment fails and a balance remains unpaid past due, Tent Apps reserves the right to charge a late fee of 1% per month, suspend work, or temporarily disable your website and mobile app access until the balance is resolved.
  • Cancellation: You may cancel your subscription at any time through your account dashboard. Upon cancellation, your service will remain active until the end of your current paid billing cycle, after which your website and app will cease to function. No refunds are provided for partial months or unused time.

3. Acceptable Use and System Integrity

You agree not to abuse, disrupt, or exploit the Tent Apps platform. Specifically, you shall not:

  1. Attempt to breach, bypass, or test any security or authentication measures of our systems.
  2. Reverse engineer, decompile, or disassemble any part of our platform in an effort to access source code.
  3. Take any action that imposes an unreasonable load on our network infrastructure or third-party service providers.
  4. Share your account password or allow multiple unauthorized users to access the administrative dashboard using a single shared login.
  5. Upload content that is unlawful, defamatory, abusive, sexually explicit, or promotes bigotry or hatred.

Tent Apps reserves the right to immediately remove any content or terminate/suspend accounts found in violation of this policy, at our sole discretion, without warning and without a refund.

4. Client Content & Intellectual Property

  • Your Content: You retain sole ownership of all text, data, images, logos, audio files, or sermon videos that you upload to the platform. You guarantee that you own or have explicit permission/licenses to use all materials uploaded.
  • Our Technology: Tent Apps owns the underlying software, layout code, mobile app framework, templates, and technology. Your website and mobile app are powered by Tent Apps and will not function outside of our hosting environment.
  • Platform Credits: Tent Apps reserves the right to display a small design credit (“Powered by Tent Apps”) in the splash screen of your mobile app and the footer of your website.

5. Third-Party Integrations & Additional Costs

  • Third-Party Technology: Our platform integrates with third-party systems (e.g., Planning Center, Ministry Brands, WordPress plugins, YouTube, Vimeo). Tent Apps cannot be held liable for any outages, errors, failures, or API changes caused by these third-party services.
  • Usage Fees (Stripe & Twilio): If you utilize our integrated giving solutions, transaction fees apply via Stripe (approx. 3%). If your plan includes virtual phone numbers or SMS features, standard usage fees passed along from our provider (Twilio) will apply per message segment.

6. Disclaimers & Limitations of Liability

  • “As-Is” Software: We strive for continuous uptime, but we cannot guarantee our work or platform will be completely error-free or uninterrupted.
  • Limitation of Damages: To the maximum extent permitted by law, Tent Apps will not be liable to you or any third party for lost profits, lost savings, data loss, or any incidental, consequential, or special damages arising out of software outages, bugs, or use of the platform.
  • SEO Disclaimer: For marketing plans, we utilize search engine optimization (SEO) best practices but cannot guarantee specific search placement rankings or be held responsible for declines in search traffic.
  • Compliance Disclaimer: Tent Apps does not provide legal advice. Compliance with local privacy, data protection, or accessibility regulations (including but not limited to HIPAA, GDPR, CCPA, or ADA website compliance) remains solely the responsibility of the Client.

7. Indemnification

You agree to indemnify, defend, and hold harmless Zack Esgar Website Design, LLC DBA Tent Apps, its officers, and employees from and against any losses, damages, or legal costs (including attorneys’ fees) arising out of your breach of these Terms, your user-contributed content, or your violation of any law or rights of a third party.

8. Governing Law & Severability

  • Governing Law: These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or severed, and the remaining terms will remain in full force and effect.
